BUTTE, Mont. (AP) — A Butte man who was struck by a vehicle after leaving a wake service has died, and prosecutors are reviewing his medical files to determine whether to charge the driver with his death.

Jack Lean already faces a charge of negligent vehicular assault after police say he struck 80-year-old Thomas Kelly in a crosswalk while driving drunk on March 3.

Kelly died last Thursday after being hospitalized since the accident.

Butte Deputy County Attorney Mike Clague tells the Montana Standard (http://bit.ly/10PAvCk) his office is reviewing Kelly's records to determine whether his death is due to the accident.

Lean has not entered a plea to the assault charge. He is free on bond.
