Senate candidate Troy Downing's lawyers are asking a judge to throw out several charges alleging he violated the law. Charges include unlawful purchase of or applying for a resident license by a nonresident. The charges accuse him of illegally buying licenses between 2011 and 2016.

Some of Downing's past tax returns make it seem like he was not living in Montana when according to him he was. Downing is claiming that his past accountants made errors when filing his tax returns.

Downing's lawyer filed a motion in Gallatin County Justice Court stating the residency listed on the Big Sky businessman's tax returns is wrong and being corrected. Downing's team is requesting that the documents be redacted from court records.

Investigators have said Downing's time in Montana was "seasonal at best" during the years in question. Downing says he lived here but he traveled for business.
